DHS to Require Registration & Fingerprinting for Certain Noncitizens

While not final, and exemptions to the rule still need clarifying, the US Department of Homeland Security has issued an Interim Final Rule to require noncitizens staying in the U.S. for 30 days or more to register and provide fingerprints if they have not done so in the normal course of their visa registration processes.  Registration is expected to be completed online through MyUSCIS, and fingerprinting will be scheduled at a USCIS Application Support Center. 


If applicants have completed fingerprinting during the visa or green card process, then depending on the final rule (expected in April 2025), they may be exempt from the new registration requirement. 


While Schear Immigration continues to monitor developments, we would highlight that failure to comply may result in fines of up to $5,000 or imprisonment. Noncitizens age 14 and older must register, while parents or guardians are responsible for registering children under 14.  Also, those 18 and older must carry proof of registration at all times.
